1. Services Provided

Aquavida Pools and Spas LLC specializes in the design, construction, and maintenance of swimming pools, spas, and related outdoor living features. Services may include, but are not limited to:

• Pool construction and subcontracted work
• Outdoor features (pavers, patios, kitchens, fencing, water features)
• Optional maintenance and service packages

2. Quotes & Estimates

• All quotes provided are valid for 30 days from the date of issue.
• Final project costs may vary depending on site conditions, material availability, design changes, or customer requests.
• Financing options are provided through third-party lenders such as HFS Financial. Aquavida Pools and Spas LLC is not responsible for loan approvals, denials, or terms.

3. Payments & Financing

• A standard payment schedule will be outlined in each construction contract. Payments must be made on time to avoid project delays.
• Customers who choose financing must comply with their lender’s terms and conditions.

4. Permits, Inspections & HOA Approvals

• Customers are responsible for securing HOA approvals unless otherwise stated in the contract.
• Aquavida Pools and Spas LLC will handle city permits and inspections required for construction. Delays due to city/HOA review processes are outside our control.

5. Warranties

• Pools are covered by a structural warranty as outlined in the customer’s contract.
• Equipment is covered under manufacturer warranties (e.g., pumps, filters, heaters, automation).
• Warranty claims are subject to terms and exclusions listed in the customer agreement.

6. Subcontractors

Aquavida Pools and Spas LLC works with trusted subcontractors for specialized trades (excavation, steel, gunite, plumbing, electrical, plaster, etc.). Customers authorize us to manage subcontractor scheduling and payments on their behalf.

7. Liability

• Aquavida Pools and Spas LLC is not responsible for delays caused by weather, labor shortages, material supply issues, city inspection delays, or HOA restrictions.
• Customers are responsible for maintaining safe access to the property during construction.
• Once construction is complete and accepted by the customer, Aquavida is not liable for damage caused by misuse, lack of maintenance, or natural events (storms, floods, etc.).

8. Changes to Project Scope

Any changes requested after work has started (design changes, material upgrades, additional features) will require a written change order and may affect cost and timeline.

9. Website & Marketing Content

• All images, text, and materials on our website are property of Aquavida Pools and Spas LLC.
• Customer testimonials, photos, or completed project images may be used in our marketing materials unless the customer opts out in writing.

10. Governing Law

These Terms & Conditions are governed by the laws of the State of Texas. Any disputes shall be resolved in courts located in [Insert County], Texas.
